SMSC has a designated ATV park (see [Park Location] tab). The park was set aside for Community members and invited guests only. There are a set of rules established for the park approved by the SMSC’s General Council and enacted by the SMSC Business Council (see [Rules] tab). All riders must sign the release form that authorizes the Community member and the children of Community members to be solely responsible for their actions within the ATV park (see [Release Form] tab). ATV’s should be properly trailered and brought to the site through the park access and not driven via shortcuts through other SMSC lands.

 

GENERAL RULES

  • The track is for the exclusive use of Shakopee Mdewakanton Sioux Community members and invited guests. Any invited guest must be accompanied by a Community member at all times.
  • No alcoholic beverages of any kind are allowed in the parking, pit, or track areas. Possession of any such alcoholic beverages will be grounds for immediate suspension of riding privileges.
  • No fireworks of any kind are allowed in the parking, pit, or track areas.
  • No pets are allowed in the parking, pit, or track areas.
  • All vehicles, regardless of type, must have a working brake system.
  • All persons entering the track area must sign a waiver of responsibility.
  • A designated guardian must be present for all children, especially younger riders.
  • All trash must be deposited in the trash containers.

 

TRACK AND RIDING RULES

  • All riders must wear all protective equipment including a helmet, eye protection, a chest protector, boots above ankle height, gloves, a jersey, and riding pants. Failure to possess and wear protective equipment will be grounds for immediate suspension of riding privileges.
  • All helmets must be DOT or Snell approved.
  • Non-riders are not allowed in the track area including parents or friends of riders.
  • Only ATVs and dirt bikes are allowed on the track.
  • The parking area is for unloading, loading, and parking only. It is not part of the track.
  • Any vehicle ridden in the pit or parking area must be ridden at walking speed only.
  • No person is allowed in or near the posted pond area. Entering the posted pond area will be grounds for immediate suspension of riding privileges.
  • Riding is restricted to marked trails. Riding off marked trails will be grounds for immediate suspension of riding privileges.
  • Riders who are not completing the larger doubles and triples must stay out of the “fast line”.

Adult Release Form:

SHAKOPEE MDEWAKANTON SIOUX (DAKOTA) COMMUNITY
OFF ROAD VEHICLE SITE AUTHORIZATION AND ASSUMPTION OF RISK

I, ______________________________ (hereinafter “Rider”), am 18 years of age or older
and hereby voluntarily and completely release the Shakopee Mdewakanton Sioux Community,
its employees, agents, associates and volunteers (hereinafter “Community”) from any and all
claims for any damage, injury, or other loss, direct or consequential, resulting from Rider’s use
of the Off Road Vehicle Site, (hereinafter “Site”). Rider acknowledges that rider’s use of the
Site may result in injury or other loss to her or his body and health, and hereby represents and
warrants that Rider voluntarily agrees to assume the risk of any such injury.
Rider shall be solely responsible and liable for all loss, damage, disability, and/or injury,
whether physical, emotional, or mental, indirectly or directly suffered, caused, and/or resulting
from Rider’s use of the Site, including any act or omission of the Community. Rider further
agrees to indemnify, defend, and hold harmless the Community against any and all claims, loss,
and/or damages brought, alleged, or instituted by Rider, any third party whomsoever, including
any of Rider’s fiduciaries, health or other insurance carrier.
Rider acknowledges that rider’s health insurance coverage shall be considered the sole
means to cover any health or medical related costs arising from Rider’s use of the Site. Nothing
in this waiver shall constitute or be construed as a waiver of the Community’s sovereign
immunity from suit.
After reading this form, Rider voluntarily and fully agrees to its terms.
